Terms governing Fit or Forfeit and related services

Acceptance of Terms
These Terms of Use govern your access to and use of the Fit or Forfeit mobile application, website, and related services operated by Caleb Burleson (“Fit or Forfeit,” “we,” “us,” or “our”).
By creating an account, accessing, or using Fit or Forfeit, you agree to these Terms of Use and acknowledge our Privacy Policy. If you do not agree, do not create an account or use the service.
Eligibility
You must be at least 13 years old to create an account or use Fit or Forfeit.
By creating an account or using the service, you represent that you are at least 13 years old and have the legal capacity to agree to these Terms. If you are under the age of majority where you live, you should review these Terms with a parent or legal guardian.
Users under 13 are not permitted to create or use an account.
User Accounts
Certain Fit or Forfeit features require an account. You agree to provide accurate information and to keep your account information reasonably current.
You are responsible for protecting your password, device, and login credentials and for activity occurring through your account. You may not share, sell, transfer, or allow another person to misuse your account.
Contact support@calebburleson.com promptly if you believe your account has been accessed without authorization.
Limited License
Subject to your compliance with these Terms, Fit or Forfeit grants you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the service for its intended personal purposes.
You may not copy, sell, sublicense, distribute, reverse engineer, modify, interfere with, or attempt to gain unauthorized access to Fit or Forfeit, except where such a restriction is prohibited by applicable law.
Fit or Forfeit and its content are licensed, not sold.
Challenges and Participation
Fit or Forfeit allows users to create, join, and participate in fitness challenges, groups, and accountability activities.
Challenge creators and participants are responsible for reviewing the challenge rules, requirements, dates, proof standards, and any optional stake before joining.
Progress, rankings, streaks, badges, and results depend on information submitted by users or obtained through authorized integrations. We do not guarantee that every submission or result will be accurate, complete, or free from error.
Optional Stakes and Independent Settlement
Some challenges may include optional stakes agreed to privately by participants. Fit or Forfeit does not collect money, process payments, hold funds, act as an escrow service, transfer stakes, enforce debts, or settle financial obligations between users.
Any stake is a voluntary private agreement between participants and must be settled independently outside Fit or Forfeit. Fit or Forfeit is not responsible for unpaid stakes, payment disputes, losses, or disagreements between participants.
Users are responsible for ensuring that their activities comply with all laws and regulations applicable where they live.
Health and Safety
Fit or Forfeit provides tools for accountability, workout tracking, communication, and motivation. It does not provide medical diagnosis, medical treatment, rehabilitation services, emergency services, or individualized medical advice.
Exercise and physical activity involve risks, including soreness, falls, injury, illness, and other adverse outcomes. You are responsible for selecting activities appropriate for your health, experience, environment, and abilities.
Consult a qualified healthcare professional before beginning or changing an exercise program when appropriate. Stop exercising and seek appropriate care if you experience concerning symptoms.
Apple Health and Fitness Information
Fit or Forfeit may allow you to connect eligible activity information from Apple Health.
You control whether access is granted and which eligible data types may be accessed. Information obtained through Apple Health is used to support selected Fit or Forfeit features and should not be treated as medical advice or a guarantee that an activity was completed safely or correctly.
User Content and Workout Proof
You retain ownership of photos, videos, text, profile information, comments, and other content you submit to Fit or Forfeit.
By submitting content, you grant Fit or Forfeit a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process that content only as reasonably necessary to operate, secure, and improve the service.
You represent that you have the rights and permissions necessary to submit your content and that your content does not violate another person’s privacy, intellectual property, or other legal rights.
Community Standards and Prohibited Conduct
You agree not to use Fit or Forfeit to:
• Harass, threaten, bully, impersonate, exploit, or harm another person
• Upload unlawful, fraudulent, deceptive, hateful, sexually explicit, or abusive content
• Submit false or misleading workout proof
• Manipulate challenge results, rankings, subscriptions, or app functionality
• Infringe intellectual property, privacy, publicity, or other legal rights
• Distribute malware, spam, unauthorized advertising, or harmful code
• Attempt to bypass security, access another user’s account, or disrupt the service
• Use the service for unlawful gambling, fraud, or other illegal activity
We may investigate reported conduct and remove content or restrict accounts when reasonably necessary to protect users or the service.
Premium Features and Subscriptions
Fit or Forfeit may offer Premium features through an auto-renewable subscription purchased through the Apple App Store.
Available plans, prices, billing periods, trials, and included features are displayed before purchase. Subscriptions renew automatically at the end of the applicable billing period unless canceled through your Apple account before renewal.
Apple processes subscription payments and manages billing, cancellation, and applicable refunds. Deleting the Fit or Forfeit app or account does not automatically cancel an active App Store subscription.
Premium features may change as the service develops, subject to applicable law and any commitments displayed at the time of purchase.
Third-Party Services
Fit or Forfeit may interact with third-party services, including Apple Health, the Apple App Store, StoreKit, notification services, backend providers, and external payment applications voluntarily selected by users.
We do not control third-party services and are not responsible for their availability, accuracy, security, content, transactions, or privacy practices.
Your use of third-party services may be governed by separate agreements between you and the applicable provider.
Intellectual Property
Fit or Forfeit, including its name, logo, design, software, graphics, features, original content, and branding, is owned by Caleb Burleson or applicable licensors and is protected by intellectual-property laws.
Except for the limited right to use the service under these Terms, no rights or ownership interests are transferred to you.
You may not use Fit or Forfeit branding, logos, or content in a way that suggests endorsement or affiliation without prior written permission.
Service Availability and Changes
We may update, modify, suspend, discontinue, or restrict portions of Fit or Forfeit as the service develops.
We do not guarantee that Fit or Forfeit will always be available, uninterrupted, secure, error-free, or compatible with every device, operating system, integration, or third-party service.
Maintenance, technical failures, security issues, third-party outages, or other circumstances may temporarily affect access.
Disclaimer of Warranties
To the fullest extent permitted by applicable law, Fit or Forfeit is provided on an “as is” and “as available” basis.
We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and results, whether express, implied, or statutory.
We do not guarantee any particular fitness, health, financial, behavioral, challenge, or performance outcome.
Limitation of Liability
To the fullest extent permitted by applicable law, Caleb Burleson and Fit or Forfeit will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to your use of or inability to use the service.
This includes damages or losses relating to injury, user content, challenge participation, optional stakes, external payments, lost data, interrupted access, third-party services, or interactions with other users.
Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
Account Suspension, Termination, and Deletion
You may stop using Fit or Forfeit at any time and may initiate deletion of your account using the account-deletion feature available within the app.
We may suspend, restrict, or terminate access when we reasonably believe an account violates these Terms, presents a safety or security concern, infringes another person’s rights, exposes the service or users to legal risk, or is being used fraudulently.
Account termination does not automatically cancel an App Store subscription. Subscription cancellation must be completed through your Apple account.
Sections that by their nature should survive termination—including provisions addressing ownership, disclaimers, liability, and disputes—will remain effective.
Changes to These Terms
We may update these Terms as Fit or Forfeit changes, as legal requirements evolve, or as new features become available.
Revised Terms will be posted on this page with an updated “Last updated” date. Where required, we may also provide notice through the app or another appropriate method.
Continued use of Fit or Forfeit after revised Terms become effective constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
Any dispute that is not resolved informally will be handled by a court with appropriate jurisdiction in Texas, unless applicable consumer law provides you with the right to bring a claim elsewhere.
Apple App Store Terms
If you access Fit or Forfeit through the Apple App Store, you acknowledge that these Terms are between you and Fit or Forfeit, not Apple.
Apple is not responsible for operating, maintaining, supporting, or providing Fit or Forfeit. Your use of the app is also subject to applicable Apple Media Services terms and the Apple Standard End User License Agreement.
Apple and its subsidiaries are intended third-party beneficiaries of the applicable license terms and may enforce those terms as permitted by the applicable agreement.
